For the couple/father conceiving with donated semen is legal in India since many years.
The intended father becomes the undisputed legal father of the child and has all the legal rights of a father.
The child born through donor sperm has all the legal rights of a child conceived naturally through a marriage.
Intended father becomes a legal father and hence has all legal responsibilities and liabilities of a child.
Any child conceived through donor sperm becomes the child of the intended parents and they have to accept all the possibilities which may come with a pregnancy and a child birth e.g. miscarriage, preterm child birth (early delivery), minor birth defect in child, major birth defect, growth problem, genetic problem, etc.
In short any child conceived through donor sperm has to be treated as a naturally conceived child by the couple and accept all benefits and the problems of natural conception.
For the Semen Donor
- Identity of a donor remains unknown.
- Intended father/parents of a child born do not know about the identity of the donor.
- Donor has no legal liability of the child born through sperm donation.
- Sperm donor has no legal rights on the child born through sperm donation.
- Identity of the intended father/parents, remain unknown to the donor.
